Mediation of Divorce and Family Issues Mediation is a method of dispute resolution used when a couple has decided to divorce and they wish to control the process. Mediation can be used in a wide variety of divorce and family issues including: § Divorce § Pre-nuptial agreements § Domestic partnerships § Post divorce disputes When a couple decides to terminate the relationship they must: § Restructure the family unit – parties need to agree on issues such as living arrangements for themselves and children, child care, parenting and education. § Focus on financial issues – both parties must plan their financial future and determine if either of them will require support. If they have children in common they must make provision for the support of the children. § Distribute property and debt - an agreement will have to be made between the parties to divide the property they own such as a home, bank accounts, pension and retirement accounts as well as furniture and household goods. Distribution of debt, including credit card debt, will need to be determined. § New Jersey State statutes and case law – New Jersey, like every state, has certain laws and court decisions which govern the rights of parties involved in divorce or termination of a relationship.
